I’m always surprised at the ways individuals can shift liability to a businesses/the state. I don’t necessarily disagree as those actors do everything in their power to avoid responsibility, but it’s amazing how waivers and ‘at your own risk’ signs don’t really hold up under scrutiny

I wouldn’t be surprised if a health insurance company was pushing the lawsuit. I wrecked my mountain bike once and my insurance did everything they could to find someone else to pay for my hospital bills. Unfortunately for them I just ran out of talent.

None of the cars are particularly safe to be honest. One is a 700 hp car from 1970, one is infamous for rolling, and the other likes to burst into flames.

It’s likely the insurance companies who want this. They HAVE TO go after all potentially responsible parties just to mitigate risk. It likely won’t stand up in court, but there will still be a settlement and then all the attorneys can go back to their clients and say “see, we did the best we could”. It’s the way the legal system (and insurance system) works.

I know I guy that was forced by his insurance company to sue his adult son after he broke his leg when he slipped on the son’s driveway in a snow storm.
This is all about the insurance company recovering their losses.

I’m confused, do you mean forced as in would rescind coverage if he didn’t, or in order to get any money at all? And would this not be insurance co v insurance co? That is so bizarre I have so many questions

I kind of doubt it. I know hemmings and safeco(progressive) make you send photos of the engine and sign if it is stock or mo dified. i almost wonder if that may be a factor.

Depending who he has hart’s insurance could be very strict when if they asked if any engine modification have been done, that could void your policy.I’ve had to send photos of both the 914 and 911 to hagerty. The 914 from multiple angles, I suspect by the number of crazy swaps people do.

The only precedent I can think of is the Meadow Walker vs Porsche lawsuit after Paul Walker’s death. Porsche knew they could win because the CGT met all 2005 crash safety standards , but it wasn’t worth the bad publicity of going after the daughter of a beloved moviestar , so they just paid her off.

This is almost certainly the opposite: a business (the injured person’s insurance company) trying to push liability to an individual (anyone but them, but preferably Hart, who has money). That’s actually a lot more common.
